Terms of Use
These draft Terms describe proposed rules for Masbatch websites, applications, documentation, support, and related services. They do not take effect through account creation or use alone. If approved, they take effect only when properly presented and accepted by you or an authorized representative, or incorporated into a signed agreement.
Agreement and eligibility
These draft Terms are not accepted merely by creating a MAS account or using Masbatch. If approved, they take effect only when they are properly presented and accepted by you or an authorized representative, or incorporated into a signed agreement. You must be at least 18 years old, or the age of legal majority where you live, and able to enter a binding agreement. If you accept approved Terms for a company, you must have authority to bind it; in that case, 'you' includes the company. A signed order form or separate written agreement controls where it conflicts with approved Terms.
Accounts and workspace administration
Provide accurate information, keep credentials and recovery methods secure, and promptly report suspected unauthorized access through the contact method designated in an approved agreement or notice. MAS OS manages the shared account, company membership, and assigned application roles. Masbatch enforces the Masbatch access and permissions it receives from MAS OS. A company owner's or authorized administrator's actions in MAS OS may change your access to Masbatch. Within Masbatch, authorized users control workspace settings, exports, operational records, support access, and deletion requests according to their permissions. You may not share an account or bypass authentication or permission controls.
Customer data and operational responsibility
You retain ownership of content you submit to Masbatch. You give us a limited right to host, copy, process, transmit, display, and back up that content only as needed to provide, secure, support, and improve the service and meet legal duties. You confirm that you have the rights and lawful basis needed to provide the content and instructions you submit. You are responsible for the accuracy, legality, quality, and use of product, inventory, batch, expiry, supplier, customer, quality, and other operational records, and for maintaining any independent records required by law or your quality system. Masbatch supports work and traceability; it does not replace professional, regulatory, safety, quality, or legal judgment.
Acceptable use
You may use Masbatch only for lawful business purposes. You must not infringe rights; upload unlawful, malicious, deceptive, or harmful material; access another customer or user without permission; probe, disrupt, overload, or circumvent the service or its security; introduce malware; scrape or copy the service except through permitted features; reverse engineer it except where law cannot prohibit that restriction; use it to build or benchmark a competing product without written permission; or help anyone do these things. You must comply with applicable privacy, employment, export-control, sanctions, product-safety, and industry rules.
Service operation, beta features, and integrations
We aim to keep Masbatch reliable and secure, but the service may be unavailable for maintenance, updates, emergencies, provider failures, or events outside our reasonable control. We may add, change, suspend, or retire features and will give reasonable notice when a material change is likely to significantly reduce core functionality, where practical. Beta, preview, or experimental features may change or stop without notice and may be less reliable. Third-party services and integrations have their own terms and privacy practices, and we are not responsible for systems we do not control.
Our technology and feedback
Masbatch and its licensors own the service, software, designs, documentation, trademarks, and related intellectual property, excluding your content. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business operations during your authorized access. If you provide ideas or feedback, you allow us to use them without restriction or payment, but we will not identify you publicly without permission.
Fees, suspension, and ending use
Masbatch is currently offered free during beta. We will not charge you unless you expressly choose a paid plan after receiving its price and billing terms. You may stop using the service at any time. We may restrict or suspend access when reasonably necessary to address a security risk, unlawful use, a serious or repeated breach, harm to others or the service, or a legal requirement. We may terminate access for an uncured material breach or discontinue the service with reasonable notice where practical. Before termination, use available export tools when you need a copy of your data; retention and deletion then follow our Privacy Policy, workspace controls, and applicable law.
Disclaimers, liability, disputes, and contact
To the fullest extent allowed by law, this draft proposes that Masbatch be provided 'as is' and 'as available,' without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. It also proposes exclusions for indirect, incidental, special, exemplary, or consequential loss, lost profits, lost revenue, loss of goodwill, or loss or corruption of data, and a total-liability cap equal to the greater of the amount paid for Masbatch in the 12 months before the event or USD 100. These proposals do not apply where law prohibits them or to liability that cannot lawfully be limited. Before any Terms take effect, they must identify the contracting party, public contact method, governing law, and competent courts. This draft does not yet establish those facts.
